Temporary disability benefit is governed by the Regulation on the Procedure for Granting and Paying Benefits, approved by Cabinet of Ministers Resolution No. 314 of 31.05.2024. The basis for payment is a certificate of incapacity for work (sick note), and the amount depends on the employee's total length of service on the day the illness began (para. 26).
From 1 July 2026 (as amended by Resolution No. 796), the Regulation covers sick leave of employees of organisations not subject to the Law on State Social Insurance, as well as the part of the period of incapacity paid by the employer (para. 1).
Benefit amount
- Total length of service of 8 years or more, and full orphans under 21 — 80% of average monthly salary (para. 24).
- Service under 8 years — 60% (para. 24).
- 100% regardless of service — employees with three or more children under 16 (under 18 if in education), in cases of work injury and occupational disease, Chernobyl clean-up participants and certain other categories (para. 22).
- For diseases of social significance (tuberculosis, cancer, etc.) — 100%, 80% or 60% depending on service: 8 years or more, 5–8 years, under 5 years (para. 23).
How to calculate
- Average salary is calculated under Art. 257 of the Labour Code: 1/12 of employment income for the 12 months preceding the month of illness (para. 37).
- Average daily pay = average monthly pay ÷ 25.3 (Art. 257 of the Labour Code).
- Benefit = average daily pay × service-based percentage × number of working days missed in the month (para. 38).
- Length of service is determined from the employment record book, including the electronic one (para. 26).
Example
An employee with 10 years of service and an average salary of UZS 6,000,000 was ill for 5 working days. Average daily pay is 6,000,000 ÷ 25.3 ≈ UZS 237,154; the benefit is 237,154 × 80% × 5 ≈ UZS 948,617.
When the benefit is not paid or is reduced
- for time spent under arrest, in compulsory treatment by court order (except for mental illness), or undergoing forensic medical examination;
- in the case of unjustified absence immediately before the illness, breach of the treatment regime, or failure to attend an examination without good reason (para. 21).
Pregnancy and childbirth
Maternity leave is 70 calendar days before birth and 56 after (70 in the case of complicated birth or twins). The benefit is 75% of average monthly salary with less than 12 months' service with the employer and 100% with more than 12 months (paras. 2, 35).
