    Updated:

A VAT refund for an individual entrepreneur (IE) is possible when the entrepreneur is a VAT payer and, for the period, the input VAT available for credit exceeds the output VAT charged. The mechanics are the same as for companies: the difference is refundable from the budget after a review.

We look at the conditions under which an IE becomes entitled to a VAT refund, how the process works step by step, which documents need to be prepared and the most common reasons for refusal. Leader Audit's experience shows that the outcome is determined by the quality of documents long before the application is filed.

When an IE becomes entitled to a VAT refund

The first condition is VAT payer status. If the entrepreneur uses a regime that does not involve paying this tax, the question of a refund does not arise: in that case the input tax is simply included in the cost of the purchase.

The second condition is that the tax available for credit exceeds the tax charged for the period. This is typical when the entrepreneur makes large purchases, invests in equipment or sells goods at a rate different from the rate on purchases.

    • the entrepreneur is registered as a VAT payer
    • for the period, the input VAT exceeds the output VAT
    • the purchases relate to taxable activity
    • the transactions are supported by proper documents
    • counterparties have correctly reported the matching transactions

Typical situations that lead to a refund

Most often the right to a refund arises for entrepreneurs engaged in exports, and for those who invested in fixed assets — equipment, vehicles, a production line — in a particular period.

Another case is a seasonal business where purchases and sales are separated in time. The VAT on purchases has already been credited, while the revenue will come in later periods.

    How the refund process works

The refund consists of several consecutive stages, and each of them can become a point of refusal. The procedure and timing of the stages are set by tax legislation, so the current requirements should be checked against the version of the rules in force.

In practice, almost everything is decided at the preparation stage. We always start with an internal review: if the documents do not survive our scrutiny, they will not survive the tax authority's either.

    • checking entitlement and calculating the amount
    • internal audit of primary documents and invoices
    • reconciling transactions with counterparties
    • preparing the return with the amount claimed for refund
    • filing the application and support during the review
    • handling requests and explanations
    • obtaining the decision and monitoring receipt of funds

    Which documents will be needed

The core of the evidence is documents confirming the purchase, its connection to taxable activity and the payment. A missing link anywhere in the chain weakens the entrepreneur's position.

Export transactions require special attention: there you need to prove not only the purchase but also the actual export of goods, so the set of documents expands to include customs and transport documents.

    • contracts with suppliers and buyers
    • invoices for purchases
    • waybills, acts, acceptance documents
    • payment documents and bank statements
    • documents confirming use in taxable activity
    • for exports — customs and transport documents

Why an entrepreneur's VAT refund is refused

A refusal is almost never about the right to a refund itself — it is about the evidence. A defect in an invoice, an inconsistency between documents or no confirmation that goods were received is enough grounds to disallow the credit.

The second most common reason is problems on the counterparty's side: it did not report the transaction, did not file its returns or shows signs of bad faith. Formally it is someone else's error, but the consequences fall on the entrepreneur.

    • defects and discrepancies in invoices
    • the purchase is not related to taxable activity
    • the counterparty did not report the matching transaction
    • no confirmation that goods or services were actually received
    • for exports, the full set of documents was not collected
    • discrepancies between returns and accounting data

How we support a VAT refund for an IE

We start by assessing the prospects: we look at the period's transactions, calculate the amount and tell you honestly whether claiming a refund makes sense. Sometimes it is more sensible to fix defects in the documents first and file the application later.

Next we carry out an internal audit of the documents and reconciliations with counterparties — this stage removes most future claims. After filing, we support the review: we prepare explanations, respond to requests and take part in resolving contentious items.

This approach saves the entrepreneur time and reduces the risk of a refusal that would then have to be challenged.

    Frequently asked questions

Can an individual entrepreneur get a VAT refund?

Yes, if the entrepreneur is a VAT payer and, for the period, the tax available for credit exceeds the tax charged. Under regimes that do not involve paying VAT, there is no right to a refund — the input tax is included in the cost of the purchase. It is best to check the status and conditions against the current version of tax legislation or in a consultation.

In what cases does an entrepreneur end up with an amount to be refunded?

Most often these are export transactions, large purchases of equipment and vehicles, and seasonal businesses where purchases and sales fall in different periods. The general logic is the same: the tax on purchases for the period turned out to be higher than the tax charged on sales.

Which documents are needed for an IE's VAT refund?

Contracts, invoices for purchases, waybills and acts, payment documents and bank statements, plus confirmation that the purchases are used in taxable activity. For export transactions, the set expands to include customs and transport documents. The list depends on the nature of the transactions and is confirmed in a consultation.

What are the most common reasons for refusal?

The main reasons are defects in primary documents and invoices, no confirmation that goods or services were actually received, inconsistencies between returns and accounting data, and problems on the side of a counterparty that did not report the matching transaction. Most of these risks are removed by an internal review before filing.

Is it worth claiming a refund on your own?

You can file yourself, but the cost of a mistake is high: a refusal will have to be challenged, and scrutiny of your books usually increases after a claim. We recommend at least an independent review of the documents before filing — it costs less than a dispute after a refusal.
